Reporting of marine casualties and occupational injuries

July 1st 2008, new requirements regarding notification and reporting of casualties came into force. The Rescue centre shall as soon as possible be notified verbally of any marine casualty and the most serious occupational injuries. All marine casualties and occupational injuries shall further be reported in writing to NMD within 72 hours.

Notification

Master or owner shall without delay notify the Joint Rescue Coordination Centre (JRCC) of any marine casualty occuring in connection with the operation of the ship. This includes:

  • loss of ship, or
  • fatality or very serious injury to personnel, or
  • damage to ship, cargo, property outside the ship or the environment, or
  • occupational accident resulting in an evacuation from the ship, even though the injury is not classified as a marine casualty

The JRCC will notify other relevant authorities.

Reporting of accidents

All marine casualties and serious occupational injuries shall be reported in writing to the NMD within 72 hours regardless if it a notification has been done to the JRCC.

The marine casualty form shall be used.

Reporting of near miss incidents

Any incidents resulting in an imminent danger which under other circumstances could have resulted in a very serious marine casualty shall be reported in accordance with the reporting requirements mentioned above.

Definitions of marine casualty and occupational injury

Marine casualty and occupational injury is defined in the regulation concerning “Notification and Reporting of Marine Casualties and other Marine Incidents”.

Marine casualty:

  • Fatalities or very serious injury, very serious damage to ship, cargo, property outside the ship or the environment in relation to operation of a ship.
  • Any incidents resulting in an imminent danger which under other circumstances could have resulted in a casualty as mentioned in item 1 above.
  • Concerning ro-ro ferries and fast speed passenger crafts, a marine casualty includes item 1 and 2, and in addition any grounding or collision involving the ship, a ship is missing or abandoned, pollution, or any near incident related to the above.

Occupational Injury:

An incident resulting in an injury to a person during or related to the operation of a ship.

The forms

NMD require the reporting forms preferably to be sent electronically by email to: postmottak@sjofartsdir.no. If electronic distribution is impossible, the forms with attachment should be sent by mail or fax.

Missing persons or serious legal offence

If crew or other persons on board are missing or one suspects that a serious legal offence has been commited, Norwegian police must be notified.

Reporting to NAV (The Norwegian Labour and Welfare Service) is required in the event of an occupational injury or disease sustained by:

  • Norwegian and foreign−national citizens employed on Norwegian ships engaged in domestic and international trade registered in the ordinary Norwegian Ship Register (NOR). 
  • Norwegian and foreign−national citizens resident in Norway, employed on Norwegian ships registered in the Norwegian International Ship Register (NIS). 
  • The same applies to foreign−national citizens who are not resident in Norway and are insured pursuant to the mutual−benefits agreement Norway has entered into with another country in accordance with the National Insurance Act, Article 1−3. As of 1 January 1994, when the EEA agreement entered into force for Norway, this also applies to citizens of EEA countries. 
  • A person working on a Norwegian fishing vessel
